Bard Settles Vaginal Mesh Case Before Trial

Bloomberg.com is reporting that C.R. Bard Inc. has agreed to settle a claim involving one of the company’s vaginal mesh implants. The case involving a New Jersey woman’s claim that Bard’s Avaulta Plus insert caused her internal problems including urinary problems was scheduled to begin on September 23, 2013 in the Superior Court of New Jersey in Atlantic City.

Last month, a federal jury in Charleston, WV awarded a woman $2 million dollars for injuries that were found to be the result of one of Bard’s Avaulta devices. This most recent settlement is the second case that Bard has settled following that jury verdict. Bard is facing more than 8,000 claims nationwide dealing with its Avaulta line of vaginal mesh inserts. Many of these cases have been consolidated to the Federal Court in the Southern District of West Virginia with others being filed in state courts in New Jersey, Missouri, and California.

It has been alleged that vaginal mesh implants manufactured by Bard, as well as implants manufactured by Johnson & Johnson, Boston Scientific Corporation, and other companies, have malfunctioned, causing a wide range of injuries to the women who have had the mesh products implanted. The most common complication from the vaginal mesh implant is vaginal mesh erosion, also known as exposure, extrusion or protrusion. This can result in severe pain, infection, urinary problems, bleeding, and organ perforation. Muscular problems and vaginal scarring have also been associated with the implants.
